These Terms of Service ("Terms") govern your use of the MOTO RIDES mobile application and related services. By using the app, you agree to these Terms and our Privacy Policy.
1. Acceptance & eligibility
- You must be at least 18 years old and able to enter a binding contract.
- You must provide accurate registration information and keep your account secure.
- One natural person per account unless we approve otherwise.
2. What MOTO RIDES is
MOTO RIDES is a technology platform that connects riders and drivers. We do not provide transportation services directly.
- We are not a transport carrier, employer of drivers, or owner of vehicles.
- Transportation is arranged between riders and independent driver-partners who use the platform.
3. Payments (read carefully)
Ride payments are processed exclusively via M-Pesa (STK push). Wallet is used only for top-ups (including saving funds in your wallet balance) and withdrawals—not for paying ride fares.
- All ride payments must be processed through the in-app M-Pesa system. Enter a valid Safaricom number and approve the STK prompt on your phone.
- Do not share your M-Pesa PIN with anyone, including drivers or support staff.
- Cancellation fines and certain account fees may be paid via M-Pesa or Wallet as shown in the app.
4. Fares & commission
- Fares are calculated in-app based on distance, vehicle type, and applicable rules.
- Platform commission on completed rides: 18% of fare.
- Driver-partner earnings on completed rides: 82% of fare (before tax obligations of the driver).
- Refunds or adjustments are handled according to app rules and applicable law.
5. Cancellations
- Riders: free cancellation may apply within the grace period shown in-app; later cancellations or no-shows may incur fees.
- Drivers: excessive cancellations may affect account standing and earnings.
- See in-app fare and fine rules for current amounts.
6. Your responsibilities
- Use the service lawfully and respectfully.
- Do not harass, threaten, or endanger others.
- Do not attempt fraud, fake payments, or account abuse.
- Follow safety instructions and local traffic laws.
7. Safety
- Use in-app emergency and support tools when needed.
- Trip and location data may be used for safety and dispute resolution as described in our Privacy Policy.
- Drivers are subject to verification requirements described in driver terms.
8. Privacy
Our Privacy Policy describes data collection and use, including that we do not sell personal data or use it for third-party advertising.
9. Suspension & termination
- We may suspend or terminate accounts that violate these Terms or pose risk to users or the platform.
- You may stop using the service and request account deletion via Profile or our deletion page.
- Outstanding fares, fines, or chargebacks must be resolved before or as part of closure.
10. Limitation of liability
To the fullest extent permitted by law, MOTO RIDES is not liable for acts of drivers, riders, third parties, or events outside our reasonable control. The platform is provided "as is." Your statutory rights under Kenyan law remain where they cannot be excluded.
11. Changes
We may update these Terms. Material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.
